A Forensic Psychologist's Perspective on Mitigation  

Speaker: Dr. Brandon Yakush 
Dr. Yakush is employed at Atascadero State Hospital spending the vast majority of his time conducting forensic evaluations as part of Forensic Services.  His work is focused on evaluating individuals committed for dangerousness and mental illness for suitability for release.  He also oversees the forensic training of predoctoral psychology interns.

Dr. Yakush maintains a private forensic practice as well focused on criminal cases, wherein he conducts competency, mental status at the time of the offense, mitigation, risk, and other evaluations for local courts and attorneys.  He has published in the area of California's definition of moral wrongfulness as applied to the State's insanity statute and how that definition impacts sanity evaluations.

A Forensic Psychologist's Perspective on Mitigation 
Forensic evaluations can provide information about the various psychological factors that may assist the prosecution, defense, and the court in determining a fair penalty through plea negotiations.  His presentation will focus on the three primary justifications for mitigation, how each can be incorporated into a mitigation evaluation, and how risk assessments are a major part of mitigation cases, especially when the primary sentencing issue is between probation and incarceration.
